S.B. 4 Update – Migrant Arrest Law on Hold, Again!

On the morning of March 19, the U.S. Supreme Court voted to allow Texas to proceed with a law permitting the arrest and deportation of migrants. However, the Fifth Circuit restored its February 29th preliminary injunction on the law which effectively stops the law from going into effect for now. The Fifth Circuit is expected to hear arguments March 20 challenging the constitutionality of SB 4. This is an ongoing case that is rapidly changing. S.B. 4, the “show me your papers” law, authorizes Texas state and local law enforcement officers to arrest people they suspect of entering the state illegally, and allows judges to order a person’s deportation to Mexico, regardless of any pending federal immigration proceedings. The law also makes the federal offense of illegal entry a state crime.
